We inform you that the access and use of the website www.sybarys.tech as well as the contracting of any of the products and services of www.sybarys.tech is subject to the present conditions of use, and we recommend that you read them carefully. The access to this website implies its automatic and unconditional acceptance and implies to act within this website in accordance with them. The user agrees to use the website in accordance with the law, this legal notice, regulations and instructions brought to his knowledge, as well as morality, generally accepted good customs and public order.

SYBARYS EDTECH holds all rights to the content, design and source code of this website, and in particular, but not limited to, the products, photographs, images, drawings, text, audio, video, software, logos and design. SYBARYS EDTECH does not guarantee that there will be no interruptions or errors in accessing the Web or its content, or that it is updated. SYBARYS EDTECH will carry out, provided that there are no causes that make it impossible or difficult to carry out, and as soon as it becomes aware of any errors, disconnections or lack of updating of the content, all those tasks aimed at correcting the errors, re-establishing communication and updating the content. The server where THE WEBSITE is hosted, is in OVH, in a hosting of the Spanish entity Innoforma Elearning Technologies, S.L.U. with C.I.F. B18915140 where maintenance and connectivity services are provided under the conditions set out in the hosting contract available on the provider’s website.

We inform you that, according to Law 34/2002 on Information Society Services (hereinafter LSSI) information society services may not infringe the following principles: (I) public order, criminal investigation, public safety and national defense; (II) the protection of public health and consumers; (III) respect for human dignity and non-discrimination on grounds of race, sex, religion, opinion, nationality, disability or any other personal or social circumstance; the protection of youth and children.

We defend these principles and in compliance with the Law we are obliged to collaborate with the competent bodies that order the interruption of the service or the removal of certain messages, consequently, we will suspend the provision of services as soon as we have actual knowledge of the activity or the information stored is illegal or injures property and rights of third parties, not being responsible for the information issued nor can SYBARYS EDTECH be held liable of any kind for the suspension and interruption of the contracted service.

We also inform you that “spamming”, or sending unsolicited mail in bulk is prohibited and that SYBARYS EDTECH follow a permission marketing policy, so we ask for your consent regarding commercial communications by electronic means that we can send.

As a result of the foregoing, and in accordance with the provisions of Title III of Chapter III of the LSSI we inform you that (I) all SYBARYS EDTECH commercial communications that you receive have been previously and expressly authorized by you or refer to SYBARYS EDTECH products and services similar to those initially contracted by you and (II) that all your personal data used for this purpose have been obtained in a lawful manner, and specifically, in accordance with Organic Law 3/2018, of December 5, 2018, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD) and its implementing regulations.

Our Privacy Policy was designed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), as well as Organic Law 3/2018 of 5 December on Personal Data and Guarantee of Digital Rights.

When you provide us with your data, you declare to have read and know the present Privacy Policy, thus giving your consent in a free, specified, informed and unambiguous way to the treatment of said personal data in accordance with the purpose and terms set forth herein.

The personal data provided will be kept unless their deletion is requested by the data subject. In any case, your personal data will be kept for the period necessary for the effective fulfilment of the purpose for which they were collected and for the time established by current legal regulations, unless consent is revoked or the right to limitation of treatment is exercised. In such cases, your data will be blocked during the legally established periods.

SYBARYS EDTECH and its collaborating entities will treat your personal data under the strictest confidentiality, applying the security, technical and organizational measures established in the applicable legislation.

9. What rights can you exercise?

The User has the following rights regarding the treatment of their personal data:

  • Right to request access to their personal data.
  • Right to request their rectification if they are inaccurate, or request their deletion (for example, if they consider that they are no longer necessary for the purposes for which they were collected).
  • Right to request the limitation of their processing, provided that any of the conditions set in the regulations is met, in which case we will only keep them for the exercise or defence of claims.
  • Right to oppose the treatment of your data, in which case we will stop treating your data, except for compelling legitimate reasons, or the exercise or defence of possible claims.
  • Right to data portability.
  • Right to revoke the consent for each specific purpose, without this affecting the legality of the treatment based on the consent prior to its withdrawal.
  • Right to file a claim with the Spanish Data Protection Agency (competent Data Protection control authority), especially when they are not satisfied with the exercise of their rights: Claim.

10. How can you exercise your rights?

We have forms for the exercise of your rights that you can request through the following email address: business@sybarys.net.

These forms must be signed electronically or accompanied by a photocopy of the valid Identification Document or Passport.

These forms can be submitted in person at Weteringschans 165 C, 1017 XD Amsterdam.

11. What is the time established to give a solution to the exercise of rights?

We will inform you about the actions derived from your request within a month, which may be extended for two more months in the case of particularly complex requests, and we will notify you of said extension within the first month.

You will be duly informed if your request is not accepted; if so, you will have a period of one month from its presentation to present your allegations.

12. How have we obtained your personal data?

By filling in the forms, checking the box “I accept the Privacy Policy” and clicking to send the data, or by sending emails to the Company through the accounts enabled for this purpose, the User declares that they have read and expressly accepted this Privacy Policy, and grant their unequivocal and express consent to the processing of their personal data in accordance with the informed purposes.

In accordance with the purposes indicated in section 2, the categories of data that will be processed are the following:

  • Identification data: name and surname(s), telephone and email.

12.1 What happens if I don’t provide any of my data?

Mandatory data will be distinguished in the information collection forms. If you choose not to provide us with any of these mandatory data, we will not be able to fulfil the intended purpose and the data will not be processed and the corresponding service will not be provided. In the event that a “commercial profile” is created on the basis of the information provided, no automated decisions with legal effects for the User will be taken.

You guarantee that the Personal Data provided by you are true and correct, and you are responsible for informing us of any changes to them. In the event that the data provided belong to a third party, the User guarantees that he/she has informed said third party of the aspects contained in this document and obtained their authorisation to provide their data.

The profiles on social networks belonging to SYBARYS EDTECH will not entail data processing beyond what the social network itself allows for corporate profiles. The Company may use these profiles to inform users of each social network subscribed to the company’s profile about its activities, events, seminars, offers, promotions or news about its products or services, as well as share information of interest on the usual topics within the company. The Company will not extract any data directly from the social network.
